Requirements for Scooters

Helmet and
eye protection required for anyone who is under 21 and/or has not had their
motorcycle endorsement for over a year.
Riding with
the headlight on during the daytime is recommended, but no required by law.
-50cc Scooter ('Moped') and under:
A 'Moped' is defined as having "No more than two (2) brake horsepower,
a cylinder capacity not exceeding fifty (50) cubic centimeters, an automatic
transmission not requiring clutching or shifting by the operator after the drive
system is engaged, and capable of a maximum speed of not more than thirty (30)
miles per hour" - KRS 189.285
A
scooter with a cylinder capacity of less than 50cc cannot be driven on
Kentucky highways.
A visibility
flag on an under 50cc scooter is recommended, but no required by law.
In order to ride a 50cc scooter and under, one must have a valid driver's
license, a valid learner's permit or a moped license. To obtain a moped license,
one must be at least 16 years of age and pass the permit part of the car driving
test (general knowledge and vision tests). For those under 18, a parent or legal guardian must give their permission
for the moped license.
-Over 50cc Scooter:
In order to ride an over 50 cc
scooter, one must have a motorcycle license or permit. In order to obtain a motorcycle
license, one must have a full driver's license and be over 18.
In order to
purchase and title a scooter over 50cc, one must have a motorcycle permit and proof
of insurance on the scooter.
Highway
riding is limited to scooters that can go over 30 MPH (over 50cc).

Indiana
law defines a vehicle as a motorized bicycle or moped only if it meets all of
the following specifications:
-It
has 2 or 3 wheels
-it is propelled by an engine of no more than 2 horsepower
-It has a cylinder capacity of less than 50 cubic centimeters
-It has an automatic transmission
-It has a maximum design speed of 25 miles per hour
Vehicles with engines exceeding these limits are defined as motorcycles and the
rider must hold a motorcycle endorsement, license or permit
To operate a motorized bicycle, you must be at least 15 years old and carry a
valid Indiana driver's license or identification card. If you are younger than
18 years of age, you must wear protective headgear and protective glasses,
goggles or a transparent face shield.
Motorized bicycles may not be operated on interstate highways or at a speed
faster than 25 miles per hour
